Each student should prepare written advice to a client in response to the following: An entertainment/media industry client is seeking your advice on a new television show it wants to produce, distribute via television and online platforms, and merchandise. The client came up with a brilliant idea for a show title and story line. The client wants to call the show “Teenage Student Ninja Warriors” and the show is based on a group of ordinary teenage students who discover they have super powers and morph into ninja superheroes who team up to protect the world from evil villains. The client assures you that he came up with the show title and premise entirely on his own and that neither the title nor the premise is based upon any pre-existing show or title. He has a limited budget that will not allow him to hire a composer to compose original music for the show so he’d like to use existing music that can be found on various YouTube videos. His good buddy, who’s also in the media industry, told him that he won’t need to obtain a license or pay a fee to use the music in his show: (a) if he uses music that is over 50 years old and has been uploaded by someone in China because it is public domain and free to use; and (b) with respect to any other music, so long as he transforms it by editing it and adding some sound effects, because that makes it ok to use under fair use. Please advise the client on the following: 1. What steps should the client take to ensure as best as it can that it will not have any problem using, registering and protecting the title “Teenage Student Ninja Warriors”? What problems do you anticipate it might encounter? 2. Does the show premise gives rise to any copyright issues? 3. If it does, what steps should the client to take to minimize those concerns? If it doesn’t, what steps should the client take to protect its copyrights to the program? 4. Should he get consent for using pre-existing music found on Youtube (both the composition and sound recording) based on the advice from his buddy? Why or why not? If he does get consent, from whom should he get it?
