1 For each of the three statements listed below, identify which of the conflict ideologies (unitarist, pluralist or radical) in employment relations is being represented AND explain each ideology. Ensure that you justify your identification by quoting which words or phrases in the statements indicate the correct ideology.

(A) “… we defend each and every achievement against the capitalist bosses; against lowering of wages, lengthening of working hours, attacks on democratic rights or infringement of national sovereignty by imperialists. Moreover, we support all struggles to improve our living standards by reforms.”

(B) “While employers, employees and unions may have different interests they also have some compatible interests which make accommodation and power sharing possible. Managerial prerogative is always crucial in ER decisionmaking and work organisation but a strong role for employee influence is possible through collective action and individual employment rights.”

(C) “Managers create a sense of common purpose and corporate culture, set targets for their employees, and invest in training and management development. Techniques to facilitate commitment, quality and flexibility include performance-related pay, profit-sharing and employee involvement. Unions are an unnecessary interference.”

2 Identify and justify which ideology underlies the Industrial Conciliation and Arbitration Act (IC&A Act) 1894 including three points that justify the ideology.

3 Identify a business, that you are familiar with, that demonstrates a different ideology from Question 2. Explain three (3) organisational behaviours that demonstrate the ideology.

1 In your own words, compare (similarities) and contrast (differences) the ‘Objects’ (‘Long Titles’) of any two (2) of the Acts listed below. Refer to Appendix 1 for the ‘Objects’. Your discussion should include identifying which ideological theory relates to each Act as expressed in Section A.

2 Explain the concept of ‘power distance’.

3 Explain how section 3(a)(ii) of the Employment Relations Act 2000 reflects Neuliep’s assessment of New Zealand’s power distance culture. Your answer should include a definition of “inherent inequality”.

1 Explain two (2) political and/or economic environmental factors, from the 1980s, that led to the introduction of the Employment Contracts Act 1991.

2 Using a relevant textbook as a reference, explain the impact on unions, employees and employers after the introduction of the Employment Contracts Act 1991.

3 Using an appropriate newspaper article and/or research of relevant case law, identify one (1) recent amendment to the Employment Relations Act 2000 relating to rest and meal breaks and discuss the environmental factors that lead to the legislative changes

for the company when he ran his own business from his home office. As time has passed, the General Manager has become more reliant on Aaron for his designs. Aaron now works in his own office at the company. He has a high spec computer in the office and works up to 45 hours a week on Steel Engineering designs. Aaron continues to invoice Steel Engineering Ltd for his time. He no longer performs contract design work for other companies. Aaron recently approached the General Manager to ask if he could go on the company’s payroll as an employee. The General Manager said he would prefer to keep him as a contractor and said that the “Hobbit law” had changed the ERA (2000) so that this type of arrangement was allowed.

1 Explain whether Aaron has a contract of service OR a contract for services. Justify your explanation by applying legal tests to determine the real nature of the relationship.

2 The Hobbit law was introduced partly because of a famous case that occurred during the making of “The Lord of the Rings” trilogy. Identify the case and briefly summarise what happened.

3 Explain how the Hobbit law changed the ERA (2000). State and quote the appropriate section(s) that were changed.

4 Explain whether the Hobbit law can OR cannot be applied to Aaron’s situation.

5 Explain what additional rights Aaron would have as an employee rather than a contractor
