Copyright Over Fan-Fictions

This dissertation would focus on the copyright law in the United States. Fan fictions are nothing but a fiction that is written by the fans of a particular TV show or movie. They are improvised versions of what the original creators have written. The major concern regarding this aspect is that the copyright over these fan fictions is generally not given to the creators. Rather, they get no protection under the intellectual property law for creating the fanfic stories. In various jurisdictions across the globe, motion pictures, feature films, music, movies or TV serials have a great fan following and such people often come up with new stories. These stories are at times copied by the producers but they are never acknowledged. This is where the dissertation would like to hit upon. It will be proved beyond any reasonable doubt that a fan fiction deserves a certain amount of copyright protection as they possess the entire essential qualifications of being a material of copyright protection.

The research questions are as follows:

• What is the difference between the copyright over original creations and fan fictions?
• Can fan fictions be said to be an extended wing that demands protection under copyright law?
• Does the doctrine of fair use and derivative work satisfy the requirements of copyright ability in fan fictions?
• Will copyright over these works not infringe the original work?
