Understanding College Policies on Academic Honesty and Plagiarism

Ensure you are aware of the College policies on Academic Honesty and also Plagiarism. Academic dishonesty and plagiarism are taken very seriously at the College even if the dishonesty or plagiarism is unintentional. Please also know that taking credit for work you did not contribute to as it is also considered Academic Dishonesty and will be reported.

This assignment will be submitted to Turnitin. Turnitin is a web-based service that checks the assignment against its database of materials that contain other learner’s work as well as electronic academic materials. Learners find the Turnitin report useful for editing papers. The report will include incorrect use of referencing, too many quotes, and paraphrases.

If the Turnitin report, for your first draft, shows a high percentage of matching text, this will give you an opportunity to review and edit your assignment for proper citations and more original analysis. Once you make your edits, it is possible to submit your work to Turnitin again. Turnitin will know not to match the text in your second draft with text in your first draft, and so on. It is advisable to wait at least hours before you submit the second draft. Faculty find Turnitin useful as a tool to teach learners proper citation practices and highlight the need for more learner originality.

Faculty can also use Turnitin as a tool to detect possible instances of plagiarism and academic dishonesty. Academic dishonesty can lead to a zero for this. Read the Tort scenario and apply your knowledge of the law to answer the three scenario questions. When answering the questions, be sure to explain the legal principles involved and apply them to the facts. Scenario Questions

1. Identify and define the torts contained in the Tort scenario. 

2. Explain what arguments could be raised on both sides and indicate the likely outcome.

3. Indicate how damages, if appropriate, would be calculated. 

Dr. No is scheduled to perform abdominal surgery on his patient, Mrs. X. A standard medical consent for the operation is signed by Mrs. X. During the operation, Dr. No notices that Mrs. X’s appendix is somewhat inflamed and decides he might as well remove the “useless organ” as a preemptive measure to save her the need for future surgery. When Mrs. X is released from the hospital, she returns home to find her neighbours, Jack and Jill, building a new garage that encroaches onto Mrs. X’s property.

The garage is built twelve inches over the property line, but it does not really affect Mrs. X’s use of her property since Mrs. X’s property is extensive and the encroachment is in a portion of her yard that she never uses. Mrs. X also owns a hotel and upon her return to work following her surgery, she finds that the amusement park located next to her hotel has decided to extend its hours until midnight during the summer. The noise from the amusement park is bothering the hotel guests.
