Many of the readings for this course are decisions rendered by courts and tribunals. To prepare for class, future assignments and exams it is essential that you acquire at least a basic skill at reading cases and identifying the relevant facts and reasons for the decisions. The goal of this first assignment is to introduce you to these skills.
Note: This assignment must be completed on an individual basis.
The reading for this assignment is “Analysis of Cases” found in Chapter 1 of the course pack.
1. Read the entire article, paying particular attention to the case of Motherwell et al. v. Motherwell, the sample briefs of this case that are provided.
2. Prepare a case brief of Gudzinski Estate v. Allianz Global Risks US Insurance Company Limited found on pp. 301-304 of the course pack. Be sure to follow the example of the first sample brief of Motherwell et al. v. Motherwell. In following this example I would like you to ignore the heading “Reasons for Judgment” (what follows under this heading can simply be treated as also falling under the “Ratio Decidendi” of the case).
