Deliverables:
1. Using one of the cases listed below (on page 2) and one other resource, prepare a written discussion brief on the potential tort liability a long-term care home (LTCH) might face similar to the tort discussed in your case. Using the risk management strategies studied in this course, discuss ways a LTCH might manage the legal risk of this tort liability; and
2. Present the case and your analysis to the class in a 10-minute (maximum) oral presentation.
Instructions:
1. This assignment is to be done in groups. Group members will receive the same mark unless there is good reason to assign different marks. We will have 4 groups of 4 students per group. You may choose your group members by signing up on BlackBoard, using the Group tool.
2. Prepare a discussion brief. Your brief must contain:
(a) a summary of the case – the key facts, the legal issue(s), analysis and outcome of the case. Make sure you discuss the classification of the tort and discuss the constituent components of the tort, e.g. if the tort is negligence, discuss duty of care etc. as applicable;
(b) a discussion of how a LTCH might face liability for the type/class of tort discussed in the case
(c) reference to, and commentary about, an article or other publication relevant to the type of tort risk in a LTCH; and
(d) a legal risk management plan (discussed in Chapter 3 of our textbook) to manage the particular risk.
3. Your typewritten brief should be no longer than six (6) pages, double-spaced. Please prepare a simple cover page with includes your name, the course code and section, and my name. Use Arial 12 Point font for your brief.
4. All members of the group must participate in the oral presentation. Discuss your brief; do not simply read your paper.
