In relation to the Tort Law topic studied in class and in Chapter 3 of your textbook, kindly state your position on the incident for your or your group (assuming that all these incidents happened in Ontario) and explain requirements of assignment #2 in the below format covering the five (5) items listed:
1. FACTS – Summarise the facts of the incident with clarity.
2. ISSUES – (Identify relevant issues in the incident) The main issues in a legal case are those that are under dispute by the parties. Issues are most often formulated in the form of a question, beginning with the word, whether. As in the following: “Whether the employer or representative owed the prospective employee a duty of care.” Note, If the issue(s) of a case are not explicitly stated, be sure to formulate them into a question. Remember, the issue(s) are the main reasons why the parties are in dispute.
3. RELEVANT LAW – (State legislation and/or caselaw on issues identified) This section will include all the relevant law involved in the case. This may include any relevant statues, case law, or regulations or tort principles from your textbook.
4. ANALYSIS – (Support your analysis with tort principles learnt in class and chapter 3 of textbook) This section of a legal case is devoted to describing how your
decision is made. It involves relying on case law (precedents) and formulating a legal test of factors or elements that must be met. There are five general elements for a successful claim in negligence (Unintentional Tort): (1) there must be a duty of care (2) the duty of care was breached (3) there is causation (4) there is quantifiable harm and (5) Remoteness.
However, in (Intentional Tort) there are three elements (1) Wrongful act or omission (2) Causation and (3) Quantifiable harm. The analysis is one of the mostimportant aspects because it demonstrates how a person arrived at his or her decision.
