To analyze a scenario involving a refugee protection claim.Specifics are provided below.

You have been retained as an immigration consultant by Khalil Salem, a citizen of Algeria, for the purpose of representing him on his refugee protection claim under IRPA. You will find Khalil’s story below.

You are required to do the following:

Draft a written submission letter on your firm’s letterhead to the Refugee Protection Division in Toronto on the merits of your client’s application and why it should be approved. In your submission letter, you should apply the requirements of the statute, regulations and jurisprudence (case law) in:

a. addressing the following issues:

i. Credibility

ii. Nexus

iii. Persecution vs. Discrimination

iv. Availability of state protection

v. Internal flight alternative in Algeria. 

b. Addressing the impact on Khalil’s claim of the following potential inadmissibility issues:

i. Criminality and/or serious criminality

ii. Health grounds
