Writing a Case Strategy Distributed: Total Marks: 50 Value: 10% of final grade Purpose of Assignment: To prepare a case strategy letter for a client, based upon the fact situation provided below. The Guidelines: ? This is an individual assignment. Please keep copies of your rough work and research as I may ask to see it. ?

The assignment must have a cover page with your name, my name, course and section number, date, and title of the assignment. Assignments must be font size 12, Arial or Times New Roman, and double-spaced. ? The paper size must be 8 ½” X 11”, and all pages must be in portrait (not landscape) format. ?

Lateness – No extensions will be granted unless supported by documentation and relating to a ground covered by the Ontario Human Rights Code. ? Some of you work for or have connections to immigration consulting firms or immigration lawyers. Do not use templates that these firms have. Use of such templates will be considered a breach of Humber’s policy on cheating. ? In the event that you took this course previously, you may not merely resubmit work that you handed in before. ? You may not share your work with anyone this semester or in any other semester. ?

Task: This assignment requires you to write a case strategy letter to a client. To do this, you need to advise your client of her options:

• for maintaining status in Canada; and

• Obtaining permanent residence.

This is your opportunity to demonstrate a working knowledge of how the failure to maintain immigration status can result in potential inadmissibility under the Immigration and Refugee Protection Act. Part of your task is to synthesize the information and include only that information which is relevant and important.

Your letter must be organized in a coherent fashion and clearly set out the various topics or issues that you are discussing. The use of headings is helpful, though not mandatory.

• 5 Marks: Form of letter, following instructions, spelling, grammar, writing style, language usage.

• 5 Marks: Introduction and Background

• 10 Marks: Identify Issues

• 30 Marks: Discussion of Issues and Recommendations to client To properly draft your case strategy letter, you should research and cite relevant legislative and regulatory provisions, case law, and IRCC resources.

The Case

• She is 26 years of age and single.

• She scored CLB 8 in all competencies on the IELTS test (taken in February 2021).

• Her study permit is due to expire on January 11, 2022.

• Her temporary resident visa expired on November 8, 2021.

• While studying, Marvid has volunteered: o on a municipal bicycle sharing project; o then at habitat for humanity; and o at a local community kitchen

• The total duration of her volunteer work is 36 months, including the last 18 months at the community kitchen.

• When Marvid last applied for permanent residence, she was told that volunteer work doesn't count towards the one-year work experience requirement.

• Marvid argues that the community kitchen job was a managerial position that should qualify as skilled work experience.

• However, under the Express Entry program, she must complete a profile and wait to be selected in a draw (which is based on a scoring system called the Comprehensive Ranking System). It is possible that Marvid will not have enough CRS points to be selected under the Express Entry program.

• One-hundred neighbourhood residents have signed a petition to the government, stating that Marvid deserves to stay because of what she has given to the community.
