Case 1: Moving Company Theft

Bill sold his house and had to move out on November 28th. He arranged for Fred’s Moving to move his furniture from the house he sold to his new house. Unfortunately, he couldn’t move into the new house until December 1st. As part of the contract Fred agreed to keep Bill’s furniture in one of Fred’s moving vans. He assured Bill that the van would be locked and also would be kept inside Fred’s fenced and locked storage yard. The driver of the van loaded Bill’s furniture but when he arrived at the storage yard the gate was already locked, and he didn’t have a key. He locked up the van and left it on the street. That night the van was stolen along with the furniture. Bill sued for the value of the furniture.

While they were in college, Larry and Libby designed, sewed, and marketed their own line of athletic wear.  Embroidered on each of the garments that they sold was a unique pattern of a running horse.  The running horse also prominently appeared on their webpage.   Although the business was very profitable, the students abandoned their on-line clothing business two years later when they were both accepted into medical school.  Two decades later, Libby’s daughter received a hoodie for her 18th birthday that her best friend had purchased from AthletiCo, the largest retailer of athletic wear in Canada.  Libby was shocked to discovery that embroidered on the back of her daughter’s hoodie was the exact same unique pattern of a running horse that she and Larry used to identify their line of athletic wear decades ago.

For over 25 years, Samson has been a highly respected marketing executive at Klondike Automotive.  Shortly after his marriage ended, Samson (now in his early sixties) met Delilah, a vivacious single 35-year-old year sales representative at the company’s Christmas party.  Delilah, who had just joined Klondike was eager to chat with Samson, whom she viewed as a potential mentor. The two spent most of the party talking about career opportunities at Klondike.    

Following the party, Samson begin sending Delilah numerous personal email messages as well as flowers and gifts.   Delilah returned the flowers/gifts and told Samson that there was NO chance of a personal relationship between them.   Nonetheless, Samson continued to send Delilah six or seven emails a day, several included rather provocative photos of himself.  Samson even told many of her colleagues and key customers that he and Delilah were romantically involved.  Delilah has complained three times to Klondike’s Human Resources Department that she is so stressed out by Samson’s unwanted attention that her health and her job performance are being negatively impacted. When the situation began too stressful, negatively impacting her health and job performance, Delilah quit.
