Bill sold his house and had to move out on November 28th. He arranged for Fred’s Moving to move his furniture from the house he sold to his new house. Unfortunately, he couldn’t move into the new house until December 1st. As part of the contract Fred agreed to keep Bill’s furniture in one of Fred’s moving vans. He assured Bill that the van would be locked and also would be kept inside Fred’s fenced and locked storage yard. The driver of the van loaded Bill’s furniture but when he arrived at the storage yard the gate was already locked, and he didn’t have a key. He locked up the van and left it on the street. That night the van was stolen along with the furniture. Bill sued for the value of the furniture.

For over 25 years, Samson has been a highly respected marketing executive at Klondike Automotive.  Shortly after his marriage ended, Samson (now in his early sixties) met Delilah, a vivacious single 35-year-old year sales representative at the company’s Christmas party.  Delilah, who had just joined Klondike was eager to chat with Samson, whom she viewed as a potential mentor. When the situation began too stressful, negatively impacting her health and job performance, Delilah quit.
