On 2 April, Nicola, a dog lover, noticed a full-page advert in the local Westminster Gazette placed by Pierre Martin, the owner of ‘Exclusive Pooches.’ The advert stated:
Five adorable Chihuahua puppies, fully vaccinated, fits into standard sized handbag, worth £500 each. First come first served. £50 each.
All you need do is collect five daily coupons from the Westminster Gazette and present them to the sales team at Exclusive Pooches.
At Soon after placing the advert Pierre realised he could not afford the promotion and placed an advert in the Westminster Gazette on April withdrawing the promotion. Nicola, unaware of the second advert, arrived at Exclusive Pooches and was first in the queue.
On entering the store with 5 coupons, she was informed by an assistant the promotion had been withdrawn. As Nicola was going to a party that evening she decided to visit Simon’s Hairdressing Salon as she wanted her hair to look special.
When Simon had finished styling Nicola’s hair, Nicola was so pleased with what Simon had done she promised to give Simon an extra £20. Nicola then found she did not have enough money to do so, but said she would call in on Monday to give Simon the £20.
Nicola has failed to pay Simon the extra £20 she promised him. Advise Nicola of any claim she may have against Exclusive Pooches, and whether she is obliged to pay the extra £20 to Simon.
