You are a solicitor working for the Crown Prosecution Service. You have been provided with a copy of the witness statements, proof of evidence and antecedent history relating to Sam Tarley and the incidents at 47 Winterfell Cottage and surrounding area on the 8th October.
(a) In light of the information provided and with reference to relevant law, advise your supervisor what offences, if any, might have been committed by Sam Tarly at 47 Winterfell Cottage.
(b) With reference to the relevant law, do you think Sam Tarly be granted bail at the Magistrates Court and what factors will the court take into account in making this decision?
(c) Do you think any of the witnesses involved in this case qualify for a special measures direction, and if so, what provisions would be available to help them give evidence?
This statement (consisting of 1 page signed by me) is true to the best of my knowledge and belief and I make it knowing that, if it is tendered in evidence, I shall be liable to prosecution if I have wilfully stated anything in it which I know to be false, or do not believe to be true.
I shouted at the man to get out of my house. He turned around and asked me what an old man like me is going to do about it. He then pulled out a meat cleaver and told me to lie on the floor with my face on the ground. I did what he said. There was the sound of some clanging and then the man started out of the room. As he was leaving, I heard the voice of Cat from the hallway. She said something like “stop”. I then heard a thumping sound and Cat cried out. The front door then opened and then slammed. I got up and saw that the man had left. Cat was lying on the floor and was rather shaken. I rang 999 and asked for the police and an ambulance. I then called Sansa so that she could look after the children while Cat and I went to hospital. The ambulance took Cat to the hospital where she was checked. It turned out that she was okay but was a little shaken and bruised. The police questioned me and we checked what was missing.
Ed woke me up in the middle of the night and told me that he had heard a noise downstairs. He told me to stay there while he investigated further. I stayed upstairs but Ed was away for a while so I sneaked down the stairs to see what had happened. I could hear some muffled talking and then the noise of some clanging – like metal on metal.
I had made it to the hallway when suddenly a tall, thin man came charging out of the room. He made directly for me and I stepped in front of him and told him to stop. He laughed and shoved me to the side. I fell to the ground and hit my head on the bottom step of the staircase. I was a little dazed and confused. The next thing I remember was Ed standing over me and the ambulance men arriving. They put me on a gurney and took me to hospital in an ambulance.
