I have had a couple of queries about choosing a case for A3, so am providing a little guidance below I have been asked if cases can be found on the Employment Court websiite. This is a possibility but not the only one! You can have a look on the Employment Relations Authority website too there are numerous cases there (many more than on the EmpCrt.


It also doesn't need to be a published case: it could be an employment dispute you read about in the news, for example. It could also, theoretically, be something you have witnessed in your own workplace, but I'd encourage you to steer clear of anything too personal, as it is hard to keep the discussion as objective as it needs to be in these circumstances Something to be wary of if you choose an EmpCrt case:  you need to be careful that you don't just follow the judge's reasoning Remember that judges are dealing with the legal aspects of the case, and the Employment Dispute Resolution paper is not only about employment law. So think a little bit outside the legal box if you choose one of these think of other ways that the dispute could have been addressed and possible outcomes Use the readings that have been provided in the course.

Strategic Case Study
Take an employment dispute and/or negotiation and examine the processes used to deal with it. You should use the materials provided and resources including the library for further reading.Do not choose a case where the full case has been provided as part of the materials.


Choose a case which allows you to:
• analyse more than one option in the dispute resolution spectrum;
• AND to discuss, using the materials covered in the paper, how the matter could have been differently approached.
Use essay format, but include other materials as appropriate.
