Scope
TMA01 tests your ability to:
- Classify different types of IP rights
- Differentiate between different forms of IP protection
- Identify sources of IP law and explain Justifications for IP protection
- Explain the nature of the rights conferred on IP rights owners for different forms of IP
- Define the requirements for securing different forms of IP protection
- Demonstrate how IP rights are applied in day-to-day situations, for example, through licensing and transfers of ownership
- Recognise where IP rights exist or are created
- Analyse the most appropriate forms of IP protection applicable to particular subject matter.
Question 1
a. Classify and analyse whether intellectual property laws protecting copyrights, patents and trademarks extend to the metaverse, and in respect of each of these rights, explain and differentiate, by reference to relevant statutory provisions under Singapore law which you should identify, the requirements for and the nature of the exclusive rights granted. (50 marks)
b. Discuss the implications of supporting or opposing the IP waiver plan. Justify with reasons, in light of the emergence of the Omicron variant, and taking into account the actions of Pfizer above, your views as to whether supporting or opposing the IP waiver are more convincing, and assess whether the IP waiver will in fact achieve practical benefits of providing more universal access to Covid-19 vaccines. (50 marks)
