Circumstances Leading to the Tragedy

Your Honor, my name is [first name] [last name], I appear for the defense of the accused (Romeo) in which he has been accused of allegedly stabbing his colleague to death with different charges being levelled against him for his stabbing actions. Your Honor, I submit to this court information that can help to solve this case beyond reasonable doubts having substantial evidence to show that the accused has been charged with false allegations which he has not been provided with an opportunity to defend or comment on the charges levelled against him. My honor, first of all I would like to bring to the attention of this court that the victim and the accused are Montagues and the Capulets are families with an age-old vendetta which clearly shows that they have a relationship where relationship matters are decided by the family members and in which failure to acknowledge family ties can result into an offence whereby the parties can erupt into a fight just to defend family ties. My honor, there is substantial evidence to show that my client was under pressure and threats to stop dating Juliet or face consequences. This is a case of a classic story of boy meets girl, the girl's family hates boy's family and eventually a fight erupts that results into death of one of the parties in the relationship argument.

Your Honor, it is evident from the documentary evidence before the court of law that the victim had a motive of harming or injuring the accused before the accused acted in self-defense to control the situation but unfortunately it resulted to casualties and eventual death of one of the hostile family members who was determined to stop the relationship from sailing through.

My Honor, the accused who is before the court of law has been accused and charged for wrong accusations because even under the provisions of common law in Australia as well as case laws, acting in self-defense is a valid action to a violent scenario in which the outcome of such violence is regarded as having been caused by provoking one to act in a manner that they did not expect to act on.

Statutory law my honor under Crimes Act 1900 provides various circumstances during which self defense mechanisms can be allowed and in case it occurs then the accused is not liable for any offence. The circumstances provided by this act include when one believes that the action condition is necessary and one is defending themselves against harm from another person and lastly, the response that the person has created should be the only reasonable response that can be applied to the circumstance that the parties were in the course of administration of the offence. My Lord, the weapon used in this case was produced by the victim and he was determined to injure the accused before the accused acted in self-defense to protect himself from being stabbed. I beseech this court to consider the submission and allow it to offer justice to parties and in particular to the accused who is innocent in this case. Thank you your honor.
