Legal requirement in nonprofit organizations and charitable trust can be registered in many ways. However, before registration the member should understand which structure suits most to their organization. Company has its own legal identity apart from their members after the registration. Non-profit organizations can be registered as public company incomplete by assurance. Under the registration, company has to mention its name.
These organizations also required permits to run their organizations effectively it can be like water permit, fire permit, sign permit etc. The company has to follow the guidelines of their government to run their company these can be rules and regulations of the company how company works and the areas where company focus. These all the rules is following by AMT and they are managing it very well.
Like all the other companies public companies has to follow the rule of insurance. In this company has to do the insurance policy of their workers, building even vehicles, which are used by the company for the welfare of the people. There is a strict rule in Australia for the insurance policy it is necessary for the companies working in Australia must have insurance policy to recover from unaccepted calamities.
Evaluation of Company Legal Structure
Every company in Australia has to register their business under the Australian Taxation Office (ATO) and the taxation policy which company pay is totally depending on the nature of their business. A unique 11-digit number is issued by the ABN to identify the business to the ATO and to the various part of government. Human resources is very important for an organization and to find the correct person with the good skills and abilities will be very much beneficial for the company but with the person with this quality will be expensive to find and to maintain is also expensive. Though AMT is non-profit organization it is very essential for them to make proper human resource policy without increasing the cost and help also works in providing a great and safe environment for their employee.
As it clearly mentioned that AMT is a nonprofit organization so there aim is not earn profit but they want to serve people for quality of life and they are doing it extremely well. Although it is a nonprofit organization but they are managing very well in terms of financial status and has a good brand value in their local area. AMT is very much focused about their mission and they built their structure in a way that will support the company to move forward to their mission. Thus it is public company there is a benefit for them that they get some deductible gifts like some relaxation in taxation policy and gets some special benefits from their government which they run for nonprofit organization. The trust of shareholders is very much necessary for the company and AMT has able to manage that trust and always remember their accountability towards shareholders as well as people.
Conclusion
In view of the above analysis, it is stated that NFP organisations of Australia are exposed to several challenges like extensive regulatory compliances, sustaining and rising diversified funding sources as income resources, frequent alteration in government procedures and plans that influences grants and substitution for such organisations. In order to defeat the challenges the government should relax regulatory. Government should emphasize budgetary provisions to aid such organisations to take developmental initiative for such organisations. NFP organisations incorporated for social welfare should uphold and deliver superior quality standard of their services.
